In these Terms:

“PicToss”

means the PicToss mobile application.

“we”, “us”, “our”

mean Ten of Clubs Studio.

“you”, “your”

mean the person using PicToss.

“Google Play”

means the Google Play Store and related Google services used to distribute the app and process purchases.

“Premium”

means paid access to additional PicToss features or removal of ads.

“Lifetime”

means a one-time paid purchase that grants access to specified Premium features for the lifetime of the PicToss app, subject to these Terms.

Acceptance of these Terms

By downloading, installing, accessing, or using PicToss, you agree to these Terms.

If you do not agree to these Terms, you should not use PicToss.

You must be at least 13 years old (or older where required by the law of your country) and legally capable of accepting these Terms. If you are a minor, you may use PicToss only with the involvement and consent of a parent or legal guardian, where permitted by applicable law.

You may also be subject to additional terms from Google Play, Google Play Billing, Google AdMob, RevenueCat, Firebase, your device manufacturer, or your mobile operating system provider.

If there is a conflict between these Terms and mandatory consumer protection laws that apply to you, those mandatory laws will prevail.

What PicToss does

PicToss helps you review, organize, and delete photos and videos stored on your Android device.

Depending on the version available to you, PicToss may allow you to:

• review photos and videos,
• swipe to keep or move items to trash,
• detect similar photos,
• browse media by time period,
• use an in-app trash list before deletion,
• delete selected files through Android system mechanisms,
• view simple local statistics such as storage freed,
• remove ads and unlock Premium features.

PicToss is not a cloud storage service, backup service, recovery service, social network, or online gallery.

PicToss does not guarantee that it will find every duplicate, similar photo, unwanted file, or recoverable storage space.

Local-first design

The core features of PicToss work locally on your device.

Reviewing your gallery, swiping, detecting similar photos, using the trash, and deleting files do not require our own server because PicToss does not use a Ten of Clubs Studio backend, database, or API.

Internet access is used only for:

• loading ads in the free version,
• processing purchases and subscriptions,
• managing Premium access,
• crash and stability reporting.

PicToss does not upload your photo or video library to Ten of Clubs Studio.

License to use PicToss

Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to download and use PicToss on Android devices that you own or control.

This license is for personal, non-commercial use unless we agree otherwise in writing.

You may not:

• copy, resell, rent, sublicense, or distribute PicToss,
• reverse engineer, decompile, or attempt to extract the source code except where permitted by law,
• modify PicToss or create derivative works based on it,
• bypass paid features, subscription checks, license checks, or advertising mechanisms,
• interfere with the operation, security, or integrity of the app,
• use PicToss for unlawful, harmful, abusive, or fraudulent purposes.

We reserve all rights not expressly granted to you.

Your responsibility when deleting photos and videos

Before confirming deletion, you should carefully review the items selected for deletion.

You understand and agree that:

• deleting a file may be permanent,
• deleted files may not be recoverable,
• PicToss may not be able to restore deleted files,
• Ten of Clubs Studio does not keep copies of your photos or videos,
• Ten of Clubs Studio cannot recover files that were deleted from your device,
• you should keep backups of important photos and videos before deleting them.

PicToss may provide features such as an in-app trash list, swipe history, undo, grouping, thumbnails, or similar photo detection. These features are intended to help you review items, but they do not replace your responsibility to check what you are deleting.

If a photo or video is important to you, back it up before deleting it.

Similar photo detection and file suggestions

PicToss may include features that detect similar photos or help you identify groups of photos that may be easier to review together.

These features are provided for convenience only.

PicToss does not guarantee that:

• all similar photos will be detected,
• all duplicates will be detected,
• detected photos are truly duplicates,
• suggested groups are always accurate,
• the best photo in a group will be obvious or automatically selected.

You remain responsible for reviewing each file and deciding whether to keep or delete it.

PicToss does not make final deletion decisions for you.

Backups and cloud services

PicToss works with files available on your Android device.

If you use another service, such as Google Photos or another cloud backup provider, copies of your photos or videos may exist outside your device.

PicToss does not control third-party backup services.

Deleting a local file through PicToss may not delete a cloud copy that has already been backed up by another service.

Similarly, deleting a file from another app or cloud service may affect what is available on your device or in PicToss.

You are responsible for understanding how your backup and sync settings work.

Free version

PicToss may offer a free version.

The free version may include:

• access to basic cleaning features,
• ads,
• feature limitations,
• usage limitations,
• prompts to upgrade to Premium.

We may change the features available in the free version from time to time.

We may add, remove, or modify free features, advertising formats, or limitations, provided this does not violate applicable law.

Advertising

The free version of PicToss may display advertisements.

Ads are provided through Google AdMob or another provider listed in the PicToss Privacy Policy.

Ads help support development and maintenance of the app.

If you purchase Premium, ads are removed from PicToss.

We do not control every advertisement shown by third-party advertising providers. If you see an inappropriate or misleading ad, you may report it using the tools provided by the advertising provider or contact us with details.

Advertising-related data processing is explained in the PicToss Privacy Policy.

Premium features

PicToss may offer Premium features through subscriptions or one-time purchases.

Premium may include, depending on the version and offer available to you:

• removal of ads,
• similar photo features,
• browsing by month or time period,
• additional file organization tools,
• folder information,
• additional reset or review options,
• other paid features introduced in future updates.

The exact Premium features available to you may depend on:

• the app version,
• the product you purchased,
• your region,
• Google Play availability,
• technical limitations,
• future updates.

We may improve, modify, rename, replace, or remove specific Premium features over time, provided this does not unfairly deprive you of the core value of the purchase you made.

Subscriptions

PicToss may offer subscription plans, such as monthly or yearly Premium access.

Subscriptions are purchased through Google Play.

Unless cancelled, subscriptions renew automatically according to the billing period shown at the time of purchase.

The price, billing period, trial period, renewal terms, and other purchase details are shown by Google Play before you confirm the purchase.

You are responsible for reviewing all purchase details before confirming a subscription.

You can manage or cancel your subscription through your Google Play account settings.

After cancellation, you may continue to have access to Premium features until the end of the paid billing period, unless Google Play or applicable law provides otherwise.

Free trials and promotional offers

PicToss may offer free trials, launch offers, discounts, introductory prices, or promotional access.

The details of any trial or promotion will be shown before purchase or activation.

If a free trial is linked to a subscription, the subscription may automatically convert into a paid subscription at the end of the trial unless you cancel it through Google Play before the trial ends.

Availability of trials and promotional offers may vary by country, user, device, platform, or time.

We may change, end, or limit promotional offers at our discretion, subject to applicable law and Google Play rules.

You may not be eligible for more than one free trial or promotional offer.

Lifetime purchase

PicToss may offer a Lifetime purchase.

A Lifetime purchase grants access to the specified Premium features for the lifetime of the PicToss app, subject to these Terms.

A Lifetime purchase does not guarantee that:

• PicToss will be available forever,
• every future feature will be included,
• every future platform will be included,
• the app will support every future Android version,
• the app will work on every future device,
• third-party services will remain available forever.

If we introduce a substantially new product, separate app, separate platform, or unrelated paid service in the future, it may require a separate purchase.

We will not intentionally remove core Lifetime benefits without a reasonable product, legal, technical, or business reason.

Purchase management and restore purchases

Purchases and subscriptions are processed by Google Play and may be managed through RevenueCat.

PicToss may include a “Restore Purchases” option or similar feature.

Restoring purchases may require:

• an internet connection,
• access to Google Play services,
• the same Google account used for the original purchase,
• successful verification through Google Play or RevenueCat.

If purchase restoration does not work, contact us at support@tenofclubs.dev and include reasonable details, such as the app version, device model, and purchase type. Do not send full payment card details.

Refunds

Payments, cancellations, and refunds are handled through Google Play.

Refund eligibility depends on Google Play policies and applicable law.

Ten of Clubs Studio does not receive your full payment card information and cannot directly manage payment methods stored in your Google account.

If you want to request a refund, you should use the refund tools provided by Google Play.

You may also contact us for support, but we cannot guarantee that a refund will be granted if it is controlled by Google Play or applicable store policies.

Price changes

We may change prices for future purchases, subscriptions, or Premium plans.

Price changes may vary by country, currency, region, tax rules, Google Play price tiers, promotional offers, or platform rules.

For subscriptions, Google Play may notify you of applicable price changes and may ask for confirmation where required.

If you do not agree with a subscription price change, you may cancel your subscription through Google Play before the new price applies.

Price changes do not automatically entitle you to a refund for previous purchases unless required by applicable law or Google Play policies.

App updates and changes

We may update PicToss from time to time.

Updates may include:

• bug fixes,
• performance improvements,
• design changes,
• security updates,
• new features,
• changed features,
• removed features,
• compatibility updates,
• changes required by Google Play or Android.

Some updates may be required for the app to continue working correctly.

We may also stop supporting older versions of PicToss where necessary for security, compatibility, legal, or business reasons.

We do not guarantee that every feature will remain available forever or work on every device.

Device and system limitations

PicToss depends on Android, device storage, media permissions, device performance, Google Play services, and other system-level features.

Some features may not work correctly if:

• permissions are denied,
• storage access is restricted,
• the device is low on memory or storage,
• the Android version is outdated,
• Google Play services are unavailable,
• the device manufacturer changes system behavior,
• files are stored in unsupported locations,
• another app changes, moves, syncs, backs up, or deletes files.

We are not responsible for limitations caused by your device, operating system, Google Play, third-party apps, cloud backup services, or manufacturer-specific restrictions.

Acceptable use

You agree not to misuse PicToss.

You must not use PicToss to:

• violate any law or regulation,
• infringe the rights of others,
• attempt to access data that does not belong to you,
• bypass purchase or subscription systems,
• interfere with ads in the free version,
• tamper with crash reporting, licensing, or entitlement checks,
• distribute modified or unauthorized versions of the app,
• upload or distribute malware,
• reverse engineer the app except where permitted by law,
• use automated systems to abuse the app or related services,
• use the app in a way that damages Ten of Clubs Studio, Google, RevenueCat, Firebase, or other users.

Intellectual property

PicToss, including its design, name, interface, features, code, branding, text, graphics, icons, and related materials, is owned by Ten of Clubs Studio or licensed to us.

These Terms do not transfer ownership of PicToss to you.

You may not use the PicToss name, Ten of Clubs Studio name, logo, branding, or assets in a misleading or unauthorized way.

You may not copy or redistribute the app except as allowed by Google Play and applicable law.

Feedback

If you send us ideas, suggestions, bug reports, feature requests, or other feedback, you allow us to use that feedback to improve PicToss or other Ten of Clubs Studio products without payment or obligation to you.

You should not send confidential information as feedback unless we have agreed in writing to receive it confidentially.

Third-party services

PicToss may rely on third-party services, including:

• Google Play,
• Google Play Billing,
• Google AdMob,
• Firebase Crashlytics,
• RevenueCat.

These services may be subject to their own terms, policies, and technical requirements.

We are not responsible for third-party services, payment systems, advertising networks, app store rules, operating system changes, or service interruptions outside our control.

Your use of Google Play and related Google services is governed by Google’s terms and policies.

Your use of third-party services may involve data processing described in the PicToss Privacy Policy.

Privacy

Your use of PicToss is also governed by the PicToss Privacy Policy.

The Privacy Policy explains how PicToss handles information, including local processing, advertising, purchases, subscription management, and crash reporting.

By using PicToss, you acknowledge that you have read the PicToss Privacy Policy.

No professional advice

PicToss is a utility app.

It does not provide legal, financial, security, archival, forensic, or professional data recovery advice.

Any storage estimates, cleanup statistics, similar photo groups, or deletion-related information are provided for convenience only.

You should make your own decisions about which files are important and which files should be deleted.

Disclaimer of warranties

PicToss is provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, we do not guarantee that:

• PicToss will always be available,
• PicToss will be error-free,
• PicToss will detect every similar or duplicate photo,
• PicToss will free a specific amount of storage,
• PicToss will work on every Android device,
• PicToss will remain compatible with every future Android version,
• deleted files can be recovered,
• the app will meet every expectation or requirement you have.

Nothing in these Terms limits any warranty or consumer right that cannot be excluded under applicable law.

Limitation of liability

To the maximum extent permitted by law, Ten of Clubs Studio will not be liable for:

• accidental deletion of photos or videos,
• inability to recover deleted files,
• loss of data,
• loss of memories,
• loss of profits,
• loss of business,
• loss of goodwill,
• device issues,
• cloud backup issues,
• third-party service failures,
• Google Play issues,
• advertising network issues,
• subscription management issues outside our control,
• indirect, incidental, special, consequential, or punitive damages.

Our total liability for any claim relating to PicToss will be limited to the amount you paid for PicToss in the 12 months before the claim, unless applicable law requires otherwise.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law.

Consumer rights

Nothing in these Terms is intended to remove or limit mandatory consumer rights that apply to you.

If you are a consumer in the European Union, United Kingdom, or another jurisdiction with mandatory consumer protection laws, you may have rights that cannot be waived by contract.

If any part of these Terms conflicts with mandatory rights under applicable law, those mandatory rights will apply.

Suspension or termination

We may suspend or terminate your access to PicToss or Premium features if:

• you violate these Terms,
• you misuse the app,
• you attempt to bypass payment systems,
• your purchase is refunded, reversed, cancelled, fraudulent, or invalid,
• we are required to do so by law,
• Google Play, RevenueCat, or another necessary service prevents verification,
• continuing to provide access would create legal, security, or operational risk.

You may stop using PicToss at any time by uninstalling the app.

Uninstalling the app does not automatically cancel an active subscription. Subscriptions must be cancelled through Google Play.

Ending or changing PicToss

We hope to support PicToss for a long time.

However, we may change, suspend, or discontinue PicToss, or any part of it, if necessary for business, legal, technical, platform, security, or operational reasons.

If PicToss is discontinued, we will try to handle existing paid users fairly and in accordance with applicable law and Google Play policies.

We are not responsible for loss of access caused by events outside our control, such as changes to Android, Google Play, payment systems, third-party services, law, or device compatibility.

Changes to these Terms

We may update these Terms from time to time.

For example, we may update them if:

• we add new features,
• we change Premium plans,
• we add or remove third-party services,
• Google Play requirements change,
• legal requirements change,
• we improve clarity or correct errors.

When we update these Terms, we will change the “Last updated” date.

If changes are significant, we may notify users in the app, on our website, or through Google Play where appropriate.

By continuing to use PicToss after updated Terms become effective, you agree to the updated Terms.

If you do not agree to the updated Terms, you should stop using PicToss and cancel any active subscription through Google Play.

Governing law

These Terms are governed by the laws of Poland, except where mandatory consumer protection laws in your country require otherwise.

If you are a consumer, you may also have the protection of mandatory laws of the country where you live.

Nothing in this section limits your mandatory consumer rights.

Dispute resolution

If you have a problem with PicToss, please contact us first at support@tenofclubs.dev.

We will try to resolve the issue fairly and reasonably.

If a dispute cannot be resolved informally, it may be handled by the competent courts according to applicable law.

If you are a consumer residing in the European Union, you may also have access to alternative dispute resolution mechanisms and consumer dispute resolution bodies available in your country. Information about consumer redress options in the European Union is available through the European Commission’s Consumer Redress in the EU resources.

We do not commit to participate in alternative dispute resolution proceedings unless we are legally required to do so under applicable law.

Severability

If any part of these Terms is found to be invalid, unlawful, or unenforceable, the remaining parts will continue to apply.

The invalid part will be interpreted or replaced in a way that best reflects the original purpose, to the extent permitted by law.

No waiver

If we do not enforce a part of these Terms immediately, that does not mean we waive our right to enforce it later.

Any waiver must be in writing to be effective.

Entire agreement

These Terms, together with the PicToss Privacy Policy and any purchase terms shown by Google Play, form the agreement between you and Ten of Clubs Studio regarding your use of PicToss.

You stay in control.

Please review carefully before deleting anything important.
